## The Zelfstandigenwet framework

The Zelfstandigenwet (Jetten Cabinet, March 2026) uses two tests:

1. **Zelfstandigentoets** (5 criteria): own entrepreneurial risk, own administration, market behavior, disability insurance provision, pension provision
2. **Werkrelatietoets** (4 criteria): free will to accept/decline, own scheduling, no organizational embedding, no hierarchical relationship

A legal presumption (rechtsvermoeden) applies for hourly rates below €38 — invokable only by the worker. Enforcement has been active since January 2025.
